Accepting these terms

These terms apply when you use this website or ask Brickworks San Jose Concrete & Masonry for a quote or for work. By using the site, you agree to them. If you don't agree, please don't use the site.

A signed written contract for your job governs that job. Where your contract and these terms differ, the contract wins.

What we do

Brickworks San Jose Concrete & Masonry is a masonry contractor in San Jose, CA. We also do concrete work for homes in San Jose and the cities around it. The services on our home page and service pages describe our work in general terms. They aren't an offer for any specific job.

What we'll do at your house is set out in your written estimate or contract. You can read more about who we are on our About page.

Estimates and pricing

We give free quotes on site because we need to see and measure the work before we can price it. Any price information on this website is general and isn't a quote for your job.

An estimate is based on what we can see at the visit. Sometimes we find conditions that weren't visible, such as damaged structure behind brick or poor soil under a slab. When that happens, we'll stop, show you what we found and agree on any change in price with you in writing before we go on.

An estimate stays open for the period written on it.

Scheduling and cancellation

We'll agree on a start date with you. Weather, material deliveries, permit and inspection timing, and conditions found once work starts can move that date, and we'll tell you as soon as we know of a delay.

If you need to reschedule or cancel, call us at (669) 234-3391 as early as you can. Your contract sets out any charges for materials ordered or work done before you cancel. Nothing in these terms limits any cancellation rights California law gives you.

Payment

Your contract sets out payment terms, including any deposit and progress payments. Final payment is due when the work in the contract is complete, unless the contract says otherwise.

If a payment is late, we may pause work until it's made. We'll tell you before we do.

Warranties and disclaimers

Our work is backed by our satisfaction guarantee. Any workmanship warranty for your job is the one written in your contract. Materials and products carry their makers' warranties, and we pass those on to you.

Masonry and concrete can show hairline cracks, slight color differences and efflorescence, a white powdery bloom, as they cure and age. These are normal and aren't defects unless your contract says otherwise.

This website is provided "as is." We try to keep it accurate, but we don't promise that every page is complete, current or free of errors.

Limitation of liability

To the extent the law allows, Brickworks San Jose Concrete & Masonry isn't liable for indirect, incidental or consequential losses arising from your use of this website.

Our responsibility for the work we do is set by your contract and by California law. Nothing in these terms limits liability that the law doesn't allow us to limit, such as liability for injury caused by our negligence.

Resolving disagreements

If something about your job isn't right, call us first. Most problems get fixed fastest when we come back out and look at them together.

If we can't settle it between us, we'll both try mediation in good faith before going to court, unless your contract sets out a different process. You can still file in small claims court if your claim qualifies.

Governing law

These terms are governed by the laws of the State of California. Any court case about these terms or this website will be heard in the courts of Santa Clara County, California, unless the law gives you the right to bring it somewhere else.

Changes to these terms

We may update these terms from time to time. The version on this page is the one in force, and changes don't alter a contract you've already signed.

If you have questions about these terms, reach us through our Contact page.
